These Terms of Service (“Terms”) are a binding agreement between you and OneLabs, LLC (“MoldCostGuide,” “we,” “us,” or “our”) governing your use of moldcostguide.com (the “Site”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract to use the Site.

What MoldCostGuide is

MoldCostGuide is a data publisher. We publish modeled, market-level estimates of mold-remediation costs, built from public data and a documented cost model, and we can help connect you with independent local service providers. We are not a contractor, inspector, or remediation company, and we do not perform mold assessment or remediation work.

Estimates are informational, not quotes

All cost figures on the Site are modeled estimates for general information only. They are not quotes, bids, appraisals, or guarantees of price, and actual costs depend on conditions specific to your property. Do not rely on our estimates as a substitute for a professional inspection or a written quote from a licensed provider.

No professional advice

Nothing on the Site is legal, financial, medical, health, or other professional advice. If you have a concern that calls for a professional — including any health-related concern — consult a qualified professional directly.

Independent service providers

Any service providers you learn about or are connected with through the Site are independent third parties. We do not employ, control, endorse, or guarantee them or their work. You are responsible for evaluating any provider, including confirming that they hold the licenses and insurance required for your project, before hiring them. Any agreement you enter into with a provider is solely between you and that provider.

How we make money

Using the Site is free. We may earn a referral fee when you choose to contact a provider through the Site. This adds no cost to you and does not change the estimates we publish. See our How we make money page.

Acceptable use

You agree not to misuse the Site, including by attempting to disrupt it, accessing it by unauthorized means, using bots or scrapers to copy its content at scale, reverse-engineering it, or using it for any unlawful purpose.

Intellectual property

The Site, including its text, data, cost models, and design, is owned by MoldCostGuide or its licensors and is protected by applicable laws. You may view and share our content for personal, non-commercial use with attribution, but you may not reproduce, resell, or redistribute it at scale, or use it to build a competing dataset, without our written permission.

Feedback and corrections

If you send us feedback, corrections, or suggestions, you grant us a non-exclusive, royalty-free, perpetual license to use them to improve the Site and our models, without obligation to you.

Disclaimer of warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, or that any estimate will match actual costs.

Limitation of liability

To the fullest extent permitted by law, MoldCostGuide and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of the Site, your reliance on any estimate, or your dealings with any service provider. To the extent liability cannot be excluded, our total liability to you will not exceed one hundred U.S. dollars ($100).

Indemnification

You agree to indemnify and hold MoldCostGuide harmless from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your dealings with any provider, or your violation of these Terms.

Third-party links

The Site may link to third-party websites and resources. We are not responsible for their content, products, or practices.

Electronic communications

By using the Site or contacting us, you consent to receive communications from us electronically, and you agree that electronic communications satisfy any legal requirement that a communication be in writing.

Governing law and venue

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. Any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Missouri, and you consent to their jurisdiction.

Dispute resolution

Before filing any claim, you agree to first contact us through our contact page and attempt to resolve the dispute informally.

Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted, and the “last updated” date will reflect the revision. Your continued use of the Site means you accept the updated Terms.

Termination

We may suspend or restrict access to the Site at any time, for any reason, without notice. The sections of these Terms that by their nature should survive termination will survive.

General

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor. Headings are for convenience only.
